The rules for competitions run by the Booker Prizes and the Booker Prize Foundation.

Rules

Note these Terms and Conditions are rules which apply to prize competitions and free draws (each a “Competition”) across our digital platforms in addition to the Website. They are of general application but subject to any specific rules as set out where the details of the Competition are displayed. Any specific rule(s) for the Competition shall prevail in the case of any inconsistency with these Terms and Conditions.

Booker Prize Foundation is the promoter of the Competition (unless otherwise stated) and any personal data relating to entrants which Booker Prize Foundation processes in connection with the Competition will be used solely in accordance with Booker Prize Foundation’s Privacy Policy.

The Competition is free to enter although standard mobile data and internet connective charges may apply.

The decision of Booker Prize Foundation is final in relation to all aspects of the implementation of the rules of the Competition and any disputes arising. No correspondence or discussion will be entered into.

Booker Prize Foundation cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. 

Booker Prize Foundation is not responsible for any technical issues in relation to any telecommunications or internet network (including in relation to speed or bandwidth), nor for damage to an entrant’s or any other person’s device related to or resulting from participation or downloading any materials arising out  of the Competition.

Eligibility

Unless otherwise stated, the Competition is only open to:

  • residents of the United Kingdom; if the rules of a specific Competition state that it is open to entrants from outside the UK, this is still subject to the proviso that an entry is not eligible if it is from a resident in a country or jurisdiction where the competition may breach any local law or regulation
  • over 18s; Booker Prize Foundation may require details and/or proof of age at any stage in the Competition and if the rules of a specific Competition state that it is open to under 18s, parental/guardian permission must be obtained by the entrant.

The Competition is not open to:

  • any employee or person involved in the governance of, or of any provider of professional services to, Booker Prize Foundation, or in each case their family or household members
  • any employee or person involved in the governance of any entity involved in the Competition, or in each case their family or household members.

By entering the Competition, the entrant warrants that they are eligible to do so. Booker Prize Foundation may take all necessary steps to verify that eligibility. Booker Prize Foundation may disqualify any entrant who it determines is ineligible or where it has reasonable grounds to suspect the entrant is ineligible, and this may result in the award of a prize to an alternate winner.

Entries

An entrant may only enter the Competition once. 

Booker Prize Foundation will disqualify any entrant it reasonably suspects of having used software or an automated process to answer questions or make bulk entries.

Entries must be received by the closing date and time. Late entries will be disqualified. Any determination in this respect is subject to proof of delivery/receipt, not proof of sending/transmission.

An entrant warrants that their entry and all information which the entrant submits and/or distributes:

  • will not infringe the intellectual property, privacy or any other rights of any third party, and 
  • will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening, and
  • that the entrant has permission to use or feature any people, content or other material contained within their entry.

Booker Prize Foundation may screen, filter and/or monitor entries to ensure that these warranties have been complied with.

Booker Prize Foundation does not accept responsibility for:

  • any failure which prevents delivery/receipt of an entry which is outside its control;
  • the safekeeping of any entries.

Entries will not be returned.

Prizes and prize winners

Where the Competition entries require subjective evaluation and/or interpretation,  Booker Prize Foundation will make clear who is responsible for judging the Competition. The decision of the judge(s) is final, and no correspondence or discussion will be entered into.

Where the Competition winner is to be selected at random, Booker Prize Foundation will ensure this is done by a means (whether digital or manual) which can be subject to appropriate independent verification.

If it is not possible for Booker Prize Foundation to contact a prize winner or to deliver a prize after reasonable and proportionate (at Booker Prize Foundation’s discretion) attempts to do so, an alternate winner will be selected.

Prizes are not transferable and there are no cash alternatives. 

Prize winners may be requested to take part in post Competition promotional activity and Booker Prize Foundation reserves the right to use the names and contact details of winners, their photographs and audio and/or visual recordings of them in any publicity relating to the Competition provided that in doing so Booker Prize Foundation is fulfilling its charitable purposes. 

Use of entries and intellectual property

Unless otherwise specified in the rules of entry, Booker Prize Foundation will not have any rights of ownership in any entry. But each entrant agrees that in consideration for the inclusion of their entry in the Competition, Booker Prize Foundation may use on the Website and other digital platforms, and in any print medium (for example, an anthology). This means that the entrant grants Booker Prize Foundation a non-exclusive, worldwide irrevocable licence to use , display, publish, transmit, copy, make derivative works (in any format) from, edit, alter, store, re-format, sell and sub-licence the entry provided that Booker Prize Foundation is at all times acting in pursuance of its charitable objectives and if it makes any charge in exercising the licensee’s rights any funds generated will be solely for the carrying out of those charitable purposes.

Where specific rules for the Competition specify that Booker Prize Foundation will have rights of ownership in the entry, the entrant may be required (and by entering agrees) to sign documentation confirming that ownership. In this situation, unless otherwise stated, the entrant will have a licence to use the entry only for personal archival/portfolio purposes but may not sublicence or in any way share or allow others to use the entry, whether or not such sublicensing/sharing/use is free of charge.
